LIFE GAMING DOOZY LAND TERMS OF USE AND PRIVACY POLICY

1. ADOPTION OF THESE TERMS AND POLICY

1.1 Life Gaming Doozy Land is an online consumer service owned and operated by Life Gaming ApS (hereinafter "Life Gaming").

1.2 These Terms of Use and the integrated Privacy Policy (hereinafter collectively referred to as the "Policy") for the use of the services available on Life Gaming's Doozy Land app (hereinafter "the App") govern the relationship between you as a user and Life Gaming regarding the use of the App.

1.3 When you use the App, Life Gaming collects data about you as a person. In this Policy, you can read about the data collected by Life Gaming, your rights, how Life Gaming processes the data, and how you can contact Life Gaming if you have any questions about our processing of personal data.

1.4 In the Policy, the terms "we", "us", and "ours" refer to Life Gaming. When you use the App, your personal data is processed in accordance with the Policy.

1.5 It is a condition of using the App that you accept the Policy. Otherwise, you will not be able to use the App. If you are under the age of 4, you must have your parents' approval to accept the Policy.

3. HOW DO YOU START PLAYING?

3.1You can start playing Doozy Land either as a guest, or you can sign in by linking the App to an existing account with Facebook.

3.2 If you have signed in by linking the App to an existing Facebook account, you will need to ask Facebook to reset your password if you forget your password.

4. THE FEATURES OF THE APP

4.1 The Game

4.1.1 With the App, you can play the entertaining and fun game Doozy Land (hereinafter referred to as "The Game").

4.1.2 You participate in the Game as a private individual and exclusively for leisure and entertainment purposes.

4.1.3 The Game, in its simplicity involves, completing the lanes in the 4 games.

4.1.4 Once you have accepted this Policy, Life Gaming gives you access to a balance of your total number of coins at any time.

4.1.5 To start playing, you will be awarded 1000 coins when you first visit or 2000 coins on your first login to the App via Facebook. You can then choose to buy coins in the Doozy Land shop (hereinafter "the Shop"), and you can under "Free coins tv" be awarded additional coins to your balance if you choose to watch an ad. Read more about ads under section 5.

4.1.6 If you leave a game in progress, the game will not be saved by Life Gaming, and you will not be able to continue playing after the interruption. Your coins will be saved in the Game until you delete the App, or you continue playing. However, if you interrupt the Game in the middle of a lane, you may lose the coins you have used on the lane.

4.1.7 You cannot redeem, sell, or exchange your balance of coins after winning coins as a prize, an erroneous purchase of coins, at the end of the Game, or if you no longer wish to use the App.

4.1.8 The prices for buying coins can be found at any time in the Shop.

4.2 Doozy Land shop

4.2.1 Payments for purchases in the Shop will be made based on an agreement that you enter into with a third party. Life Gaming is not responsible for matters related to payments.

4.3 The purchase of coins in the App is not subject to a right of withdrawal under the Danish Act on Consumer Contracts. Thus, your right of withdrawal when purchasing coins lapses when the coins purchased are deposited and available on your balance.

4.3.1 You can find the prices applicable at any time for the purchase of additional features and services in the Shop.

4.4 Hearts and coins awarded watching ads

4.4.1 Life Gaming awards you hearts and coins to use for the next game if you choose to watch ads. In the App, you can find information about how many coins you are awarded for watching the specific ad.

4.4.2 Life Gaming only awards you hearts and coins when you have watched the entire ad. A situation where you are not assigned hearts and coins may occur, for instance, if the allocation of hearts and coins for some reason is not approved or registered, or if you do not watch the entire ad. Each ad will specify how many hearts and coins you will be awarded.

4.4.3 The coins and hearts that you are awarded for ads that you have watched are deposited to your balance of hearts and coins. A pop-up message in the App will notify you of the number of hearts and coins you have been awarded after watching the ad. The App will usually be updated immediately after you watch an ad, but there may be some delay before this update occurs.

5. THE CONTENT OF THE ADS

5.1 Life Gaming is not responsible for the content of the ads that you access through the App. Life Gaming does not verify any statements in material, and errors, deficiencies, misleading, or false statements by its partners are of no concern to Life Gaming. Life Gaming accepts no responsibility or liability for such errors or defects, misleading or false statements in such marketing.

5.2 If you find that marketing does not comply with the law or is otherwise abusive, please feel free to report this to Life Gaming or the sender of the marketing in question.

6. COMMUNICATION BETWEEN LIFE GAMING AND USER

6.1 Life Gaming can on an ongoing basis notify you of important technical and legal information, for instance, about changes to terms via pop-up or push notifications in the App (hereinafter "Service Messages").

7. PROCESSING OF PERSONAL DATA.

7.1 Controller

7.1.1 Life Gaming ApS is the data controller of the personal data processed in the App.

7.1.2 The personal data will be processed in accordance with applicable data protection legislation and the Danish Data Protection Agency's applicable guidelines at any time.

7.2 Purpose and legal basis

7.2.1 Life Gaming only collects the personal data necessary for Life Gaming to provide you with the best possible service, and Life Gaming only uses your personal data for the purposes described in this Policy.

7.2.2 Playing Doozy Land To play Doozy Land as a guest, you are assigned a user identification number, and you may use a nickname. We cannot identify you based on the user identification number, and, therefore, we do not usually process personal data about you. We also encourage you not to use your full name as a nickname. If you choose to sign in by linking the App to an existing Facebook account, Life Gaming will receive information about you from Facebook, including your username and email address. For the purpose of being able to award you coins, for instance, when you visit as a guest or login in the App, you will also be linked to a transaction number. The collection of any said personal data is necessary to fulfil the agreement between you and Life Gaming on your use of the App. This includes you being able to play Doozy Land in the App, and so that we can manage your balance of hearts and coins. This is done on the basis of point (b) of Article 6(1) of the General Data Protection Regulation. If you do not wish to give this data to Life Gaming, you cannot play Doozy Land.

7.2.3 Information about your purchases in the Shop When you buy coins in the Shop, Life Gaming collects data about your purchases. The data that Life Gaming collects about you is data about what services you purchase in the Shop, such as how many coins you buy and date and time. For the purpose of completing purchases in the Shop, Life Gaming also receives a transaction key and a transaction value from Google and the Apple App Store. The data is collected for the purpose that you can purchase coins to be used for your next games in the App. The collection of this personal data is necessary in order to fulfil the agreement between you and Life Gaming on your use of the App. This includes allowing you to purchase coins for use in the next games. The legal basis for this is point (b) of Article 6(1) of the General Data Protection Regulation.

7.2.4 Information about the ads you watch When you watch ads under "Free coins tv", Life Gaming collects the data that you have watched the ad. The data is collected for the purpose that we may award you hearts and coins for use in your next games in the App. Note that if the heart bank is full, i.e. 10 hearts, you will not be awarded a heart for watching a commercial. You will only be awarded coins. The collection of this personal data is necessary in order to fulfil the agreement between you and Life Gaming on your use of the App, including that you may be awarded hearts and coins for use for the next games. The legal basis for this is point (b) of Article 6(1) of the General Data Protection Regulation.

7.2.5 Communication between Life Gaming and user Life Gaming also sends you essential Service Messages via push notifications, for instance, with information about important technical or legal matters. For the purpose of sending such push messages, Life Gaming uses third-party services, including Google LLC and Apple LLC. Your data will not be shared with the said third parties for any marketing purpose. Data is only shared with third parties to technically send you push messages. In this connection, Google LLC and Apple LLC collect a device identification number. The collection of this personal data is necessary in order to fulfil the agreement between you and Life Gaming regarding your use of our Services. The legal basis for this is point (f) of Article 6(1) of the General Data Protection Regulation.

7.3 Recipients/transfer of personal data

7.3.1 The personal data held by Life Gaming will not be disclosed to third parties without your consent unless Life Gaming is obliged under the law to disclose the data, or for Life Gaming to exercise or defend itself against legal claims.

7.4 Retention period

7.4.1 Life Gaming will, as far as possible, attempt to alert you of the deletion of your data 6 months in advance when you have not been active in the App for up to 3 years. Thus, Life Gaming stores your personal data for up to 3 years and 6 months from the time you last were active in the App. If you have still not been active in the App within the specified 6 months, all the data registered about you in the App will either be deleted or anonymised. If we do not have your contact information, we will delete your data without notice.

7.4.2 If you request the deletion of your data, your data will be deleted or anonymised immediately, and no later than within 48 hours of the request for deletion being received.

7.5 Your personal data rights

7.5.1 If you use the App by logging in via your Facebook profile, you may have a number of personal data rights. For the purpose of fulfilling these rights, we need you to provide us with your email address.

7.5.2 You have the right at any time to know what personal data Life Gaming processes about you, for what purpose, from where Life Gaming received your personal data, and who receives your personal data.

7.5.3 You have the right at any time to correct inaccurate or misleading personal data that Life Gaming process about you.

7.5.4 In some instances, you have the right to have the data that Life Gaming may process about you deleted. If you no longer wish to use the App, you can delete the App at any time. Life Gaming will not be notified that you have deleted the App, and we will, therefore, continue to retain your data until we may comply with your deletion request or until you have been inactive in Appen for an extended period, cf. section 7.4.1 above.

7.5.5 Where the processing is based on an agreement or your consent, you have the right to have the data that you have provided to Life Gaming transferred, in a structured, commonly used and machine-readable format.

7.5.6 In some instances, you have the right to object to Life Gaming's processing of your personal data due to your particular circumstances.

7.6 Redress

7.6.1 If you wish to complain about the processing of your personal data, we would appreciate it if you contact us. Life Gaming's contact information can be found in section 1.4.

7.6.2 You may also lodge a complaint with the Danish Data Protection Agency, Carl Jacobsens Vej 35, 2500 Valby, Denmark or www.datatilsynet.dk.

8. RIGHTS TO THE APP

8.1 Life Gaming holds all rights to the App, including special features and all other material on the App. This includes, but is not limited to, copyright, property, and trademark rights to the App.

8.2 As a user, you are granted a non-exclusive right of use for the App. Life Gaming may revoke this right of use at any time.

9. OPERATION ETC.

9.1 Life Gaming always seeks to avoid errors, defects, and malfunctions concerning the App. However, these may occur. Life Gaming will appreciate receiving information about such issues via the contact form in the App, and Life Gaming will seek to remedy these as soon as possible.

9.2 Life Gaming is not responsible or liable to its users in the event of errors, defects, malfunctions, or removal of features.

10. ACCESS TO THE APP

10.1 The App requires your phone to have an Internet connection to use the App's features. The App's speed and ease of use may vary depending on the phone model and network speed. Life Gaming accepts no responsibility or liability for the possible impact your Internet connection and telephone subscription may have on the usability of the App.

11. LIABILITY

11.1 Life Gaming may at no time be held liable for your use of the App. Your use of the App is your own responsibility and at your own risk at all times.

11.2 Also, Life Gaming cannot be held liable for any instances of improper use of the App and/or any accident in connection with the use of the App. Life Gaming is in no way liable for damages of any kind to you, your devices, or data stored on these devices, or for any consequences that may arise as a result.

11.3 Life Gaming is not liable for non-compliance with the agreement, damage, or loss in the event of force majeure, which includes, inter alia, virus or hacker attacks, crashes or errors in communication systems, power failures, subcontractor’s force majeure, and other unforeseen circumstances that Life Gaming could not reasonably foresee or avoid.

12. TERMINATION AND DELETION

12.1 If you disagree with the Policy or no longer wish to use the Game for any reason, you can terminate the Game at any time, sign out of the App, and/or delete the App.

12.1.1 Upon deletion of the App, we will continue to retain your personal data until we may comply with your request for deletion, or until you have been inactive in the App for an extended period of time, cf. section 7.4.1 above.

12.1.2 When we delete or anonymise all of your personal data registered in the App, the data cannot be subsequently restored. If your data is deleted, you cannot make any claims against Life Gaming. This includes claims concerning any lost of hearts and/or coins.

12.1.3 In a number of cases, you have the right to have the data that Life Gaming process about you deleted. If you no longer wish to use the App, you can delete the App at any time. Life Gaming will not be notified that you are deleting the App and we will, therefore, continue to store your data.

12.2 Life Gaming may, at any time and without notice, terminate your agreement on the use of the App and delete your data. If Life Gaming terminates your agreement on the use of the App, Life Gaming will contact you via pop-up or push notifications in the App. In the event of such termination, Life Gaming may give you a time limit within which you must use of your remaining hearts and coins. When the time limit expires, any remaining coins will be lost.

13. DISPUTES

13.1 Any disputes that may arise between you and Life Gaming must, to the extent permitted, be governed and construed in accordance with Danish law, regardless of Danish law's rules on international choice of law and venue, before the ordinary Danish courts, at Life Gaming's place of residence at any time.

14. CHANGES

14.1 Life Gaming may change this Policy at any time and without notice. The latest version is always available in the App.

14.2 You will be notified of changes to the Policy via pop-up or push notifications in the App. If you do not agree to the changed policy, you will no longer be able to use the App and Life Gaming will be entitled to delete your data.

15.1 This Policy was last updated in November 2020 and replaces all previous applicable policies.
